Taking-up and Pursuit of the Business of Insurance and Reinsurance (Solvency II)

Directive 2009/138/EC of the European Parliament and Council of 25 November 2009 on insurance and reinsurance

European Commission directive provides legal framework for harmonizing prudential requirements governing insurance and reinsurance undertakings, including capital requirements, valuation techniques, and governance and reporting standards. Sets out rules for the supervision, reorganization and winding-up of insurance and reinsurance firms and groups.

Enhancements to the Basel II Framework

BCBS enhancements to Pillars 1, 2 and 3 of Basel II

Final Basel Committee on Banking Supervision enhancements to Basel II including: i) in Pillar 1 (minimum capital requirements), strengthening the treatment for certain securitizations, introducing higher risk weights for resecuritization exposures, and requiring that banks conduct more rigorous credit analyses of externally rated securitization exposures; ii) in Pillar 2 (supervisory review process), expanding guidance addressing weaknesses revealed in banks' risk management processes during the financial crisis; and iii) in Pillar 3 (market discipline), strengthening requirements relating to securitizations, off-balance sheet vehicles; resecuritization exposures; and other risks regarding securitization exposures.

FSB Principles for Sound Compensation Practices

FSB standards to align compensation with prudent risk-taking

Financial Stability Board principles require compensation practices in the financial industry to align employees' incentives with firm's long-term profitability. Calls for effective governance of compensation, and for compensation to be adjusted for all types of risk, to be symmetric with risk outcomes, and to be sensitive to the time horizon of risks. Principles are intended to apply to all significant financial institutions but are deemed especially critical for large, systemically important firms.

Capital Adequacy Standards for Securities Firms

IOSCO longstanding common conceptual framework

International Organization of Securities Commissions framework for capital requirements for securities firms that take positions as principal, hold client accounts, and/or hold client property. Framework consists of: i) capital adequacy test that reflects liquidity, solvency and risks faced by securities firms; ii) regulatory structure for maintenance of a securities firm's books and records; and iii) framework of regular reporting to, and examination by, a supervisory authority.
