US Advanced Approaches Risk-Based Capital Rule

FRB, FDIC and OCC regulatory capital framework applicable to large, internationally active banking organizations

US Federal Reserve Board, Federal Deposit Insurance Corporation and Office of the Comptroller of the Currency final regulatory capital rules applicable to large, internationally active banking organizations that determine their regulatory capital ratios under advanced approaches rule --generally those with at least $250 billion in total consolidated assets or at least $10 billion in total on-balance sheet foreign exposures. The final rules enhance consistency of advanced approaches with Basel capital standards.

Prudential Standard on Health Insurer Solvency

APRA liquidity standard applicable to all health insurers

Australian Prudential Regulation Authority standard to ensure that the assets of a health benefit fund are sufficiently liquid such that a private health insurer will be able to meet its cash demands and unanticipated losses from its activities. Requires that, for each health benefits fund: i) the value of cash is not less than sum of cash management amount, plus any solvency supervisory adjustment amount; ii) the insurer has, and complies with, a board endorsed liquidity management plan for each health benefits fund it conducts, and ensures that the plan has been designed with regard to important factors included in this prudential standard, and is reviewed at least every two years.

Prudential Standard on Health Benefit Fund Capital Adequacy

APRA capital standard for health benefit funds conducted by private health insurers

Australian Prudential Regulation Authority standard to ensure sufficient assets in health benefits fund conducted by private health insurer to provide adequate capital for conduct of the fund. Key requirements are: i) health benefits fund must maintain required levels of capital; ii) private health insurer must have, and comply with, written, board endorsed, capital management policy for each health benefits fund it conducts, and provide this to APRA; and iii) board must review capital management policy at least every two years and as part of each review, consider insurers access to internal and external capital and impact on premiums of holding more or less capital than amount determined.

The Implementation of Ring-Fencing

PRA policy addressing legal structure, governance and continuity of services and facilities

Insurance Supervision Act: Amendment Promulgated in the Federal Law Gazette

Insurance Supervision Act (Germany)

Federal Financial Supervisory Authority of Germany (BaFin) announcement sets out amendments to German Insurance Supervision Act. Includes special rules for insurance groups and transitional provisions intended to make changeover to new supervisory regime easier for undertakings. New legislation reflects two systems: i) undertakings that fall within scope of Solvency II; and ii) companies that are not subject to European supervisory regime. Act to Modernise Financial Supervision of Insurance Undertakings enters into force on 1 January 2016, with exception of a provision which comes into effect immediately and allows BaFin, among other things, to issue certain supervisory authorizations in anticipation of Solvency II.
