Guidance for Setting Countercyclical Capital Buffers

ESRB recommendations for setting countercyclical buffer rates under CRD IV

European Systemic Risk Board recommendations for setting countercyclical buffer rates under the European Union Capital Requirements Directive (CRD IV). The countercyclical capital buffer regime follows the principle of ‘guided discretion’ whereby supervisory authorities combine a rules-based approach with the exercise of their discretionary powers in deciding on the appropriate buffer rate. Recommendations address: i) principles for assessing and setting the appropriate countercyclical buffer rates; ii) measurement and calculation of the credit-to-GDP gap, calculation of the benchmark buffer rate and the buffer guide; iii) variables that indicate the build-up of system-wide risk associated with periods of excessive credit growth, and; iv) variables that indicate that the buffer should be maintained, reduced or fully released.

Bank Recovery and Resolution Directive (BRRD)

Directive 2014/59/EU of the European Parliament and of the Council of 15 May 2014 on bank recovery and resolution

Sets out the special resolution regime for banks and investment firms in the European Union. Harmonizes and upgrades tools for dealing with bank crises. Banks are required to prepare recovery plans to overcome financial distress, while authorities must prepare plans to resolve failed banks in a way which preserves their critical functions and avoids taxpayers losses. Authorities are granted powers to intervene in the operations of banks to mitigate the risk of failure. If they do fail, authorities are equipped with comprehensive powers and tools to restructure them, allocating losses to shareholders and creditors following a clearly defined hierarchy.

Insurance Supervision Act: Amendment Promulgated in the Federal Law Gazette

Insurance Supervision Act (Germany)

BaFin announcements amendments to German Insurance Supervision Act. Includes special rules for insurance groups and transitional provisions intended to make changeover to new supervisory regime easier for undertakings. New legislation reflects two systems: i) undertakings that fall within scope of Solvency II; and ii) companies that are not subject to European supervisory regime. Act to Modernise Financial Supervision of Insurance Undertakings enters into force on 1 January 2016, with exception of a provision which comes into effect immediately and allows BaFin, among other things, to issue certain supervisory authorisations in anticipation of Solvency II.
